Updated October 9, 2009: The Arizona Department of Administration (ADOA) has announced that the recently legislated definition of dependent will not be applied to the state insurance plans this year.
The current coverage for enrolled domestic partners, dependents of domestic partners, non-students 19-25, students age 23-25, and disabled dependent children 19 and above will remain in place from October 1, 2009 through September 30, 2010.
The ADOA did indicate that the new definition will apply as of October 1, 2010. Included in the new Arizona budget legislation recently signed into law is a new definition of ‘dependent’ that states “…beginning October 1, 2009, “dependent” means a spouse under the laws of this state, a child who is under nineteen years of age or a child who is under twenty-three years of age and who is a full-time student.” (House bill 2013, p.24, line 44 – p. 25, line 2)
As applied to the current state insurance plans, this definition essentially removes coverage for domestic partners, dependents of domestic partners, non-students 19-25, students age 23-25, and disabled dependent children 19 and above.
The state has indicated that the definition will be applied beginning October 1, 2010.
